Criminal Records Bureau Disclosures

A CRB disclosure will say whether there is anything on file which you should consider before allowing that person to work with children or vulnerable adults. There are two types of disclosure:

Standard diclosures give

  • details of all convictions, cautions, reprimands and warnings held on the Police National Computer (PNC);

and if the position involves working with children or vulnerable adults and the relevant boxes have been marked on the application form to indicate this:

  • information from the Protection of Children Act List (PoCA); Information from the Protection of Vulnerable Adults List (POVA); and
  • Information held by the DfES under Section 142 of the Education Act 2002 of those considered unsuitable for banned from working with children.

Enhanced disclosures give

  • local police force information considered relevant by the Chief Police Officers in addition to all of the above.

How do I get a disclosure for my Personal Assistant?

If you want a CRB disclosure on an employee or prospective employee, speak to your Care Manager or Direct Payment Advisor who will get you the necessary forms. Your Personal Assistant will then need to complete the form and provide evidence of identity, which will be checked by either the Direct Payment Advisor, or a County Council employee.

It is important to remember that a CRB disclosure only tells you if anything is on the above files. It is not a guarantee that the person is suitable and safe for the post. You should still follow a full recruitment procedure, including interview and references.

How will the disclosure be paid for?

WCC insist that anyone who may have unsupervised contact with a child must have a check, and will therefore pay for this to be done, but they will also pay for any direct payment user to carry out a check on a personal assistant if requested. Care managers may advise this where they assess the vulnerability of the user or the level of risk to be sufficient.
